In South Carolina, most HOA bylaws, covenants and/or master deeds include articles stating that the HOA can assess the owners' property and demand payment. If payment is not received, the HOA can file a lien against the property and then foreclose on it. We assist HOAs with all collections' matters.
When we represent HOAs, we review their documents, and ensure there is power to assess and power to lien. When we know that is in place, the HOA sends our lawyers information on each delinquent homeowner, and we can begin the collection process.
HOAs use assessments to maintain their common property, including the pool, pool house, street and lights. When homeowners fail to pay their assessments, the community property deteriorates.
